Renters Rights Act 2025

The National Trust will be sending the government’s official Information Sheet to relevant Assured and Assured Shorthold tenants in England during May 2026. The Information Sheet explains how your current tenancy may be affected by the changes introduced by the Renters’ Rights Act 2025. If you hold an Assured or Assured Shorthold Tenancy and have not received this Information Sheet, please get in touch with your usual National Trust local lettings contact.

Key points:

These changes affect most private tenants with an Assured Shorthold Tenancy (AST). All ASTs will be Assured Periodic Tenancies. Protected tenancies have different terms – please see your agreement or contact TANT link if you need help or advice.

From 1 May 2026

  • Your landlord will need a legal reason to evict you with a section 8 notice. Section 21 cease to exist.
  • For tenancies starting 1st May 2026 your landlord can only take or accept 1 month's rent in advance.
  • Your landlord can only put the rent up once a year. They must give at least 2 months' notice.
  • You will have a periodic tenancy which makes it easier to leave by giving notice.
  • You will have to give 2 months' notice to end an assured periodic tenancy, unless a shorter notice is agreed in writing.
  • You will have the right to ask for permission to keep a pet. Your landlord can only say no if they have a good reason.

Some of the grounds the National Trust can use a Section 8 to evict tenants include:

a. Rent arrears

b. Anti-social behaviour

c. To sell the house (rarely applies to the NT as most properties are in alienable – and unable to be sold.
