National Trust holds restrictive covenants over approximately 1,760 properties in England and Wales amounting to some 36,000 hectares of land. These properties include many farms and houses.
TANT is aware of a number of people and farms having problems with the NT’s administration of these restrictive covenants with poor decision making and long delays. Some of the problems were recently raised in Parliament during a debate about the NT.
There needs to be a proper procedure for handling restrictive covenant applications with fixed timescales and an independent arbitration procedure or Ombudsman to oversee the process. In some cases, the NT’s current administration is slow and counter-productive, creating disputes rather than developing partnerships with farmers and landowners.
